1. What Diario Trader is

Diario Trader is a tool to record, organize and analyze your own trades, journal, rules and prop firm account tracking. It is a personal record-keeping and analysis tool.

2. Not financial advice

Diario Trader is not a financial, investment, tax or legal adviser, and is not a broker. Nothing in the service (statistics, scores, alerts, the mindset coach, the strategy library, prop firm information or any other content) is a recommendation to buy, sell or trade any instrument.

Trading futures, options, forex, CFDs and stocks carries a high risk of loss and is not suitable for everyone. Past results, real or simulated, do not guarantee future results. You alone are responsible for your trading decisions and their outcomes.

The mindset coach offers general wellbeing exercises; it is not medical or psychological care and does not replace a professional.

3. Your account

You must be at least 18 years old and legally able to accept these Terms. You must provide accurate information and keep your password secure. You are responsible for all activity in your account.

Your connection links (TradingView webhook, NinjaTrader add-on) work like passwords: do not share them. If you think someone else has access, generate a new link.

4. Your data is yours

You keep ownership of everything you record: trades, notes, screenshots, check-ins and other content ("Your Content"). You give us a limited permission to store, process and display Your Content solely to provide the service to you.

You can download a full backup of your data at any time from the Import section. You are responsible for making sure Your Content does not violate the law or anyone else's rights.

5. Third-party information and integrations

Prop firm information (rules, prices, templates) is for reference only, may be out of date and may change without notice. Always check the official rules with your firm before trading. We are not responsible for lost accounts, evaluations or payouts resulting from incorrect rules or data.

Integrations with third-party platforms (NinjaTrader, TradingView, Tradovate, thinkorswim and others) depend on those services, which we do not control. Syncing may be delayed, fail or record incomplete data; always check your trades against your broker's or firm's official statements.

The NinjaTrader add-on is read-only: it sends your executions to your journal and never places, changes or cancels orders. It is your responsibility to confirm that your prop firm allows any tool you use.

Some prop firm links may be affiliate links: if you buy through them, Diario Trader may earn a commission at no extra cost to you.

6. Acceptable use

You agree not to: copy, modify, distribute, sell or resell the service; reverse-engineer it or try to obtain its source code; extract data by automated means (scraping); try to access other people's accounts or data; interfere with the security or operation of the service; or use it for anything illegal.

7. Intellectual property

The software, design, the "Diario Trader" name, the logo and the content we create (including the strategy library) belong to Diario Trader and are protected by applicable law. These Terms give you no rights to them other than to use the service as these Terms allow.

8. Beta, pricing and changes to the service

The service is in beta and free for now. We may add, change or remove features. If we introduce paid plans later, we will tell you in advance and will never charge you without your explicit authorization.

We make reasonable efforts to protect and back up your data, but we do not guarantee the service will be error-free or uninterrupted. We recommend downloading regular backups.

9. Disclaimer of warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including accuracy of calculations, statistics or P&L, merchantability, fitness for a particular purpose or non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Diario Trader is not liable for trading losses, loss of funded accounts or evaluations, lost profits, lost data, or any indirect, incidental, special or consequential damages arising from use of, or inability to use, the service.

Our total liability for any claim related to the service will not exceed the amount you paid us in the 12 months before the claim, or 50 US dollars, whichever is greater. Some jurisdictions do not allow certain limitations; where that is the case, they apply to the extent permitted.

11. Indemnification

You agree to indemnify Diario Trader against third-party claims arising from your misuse of the service, Your Content or your breach of these Terms.

12. Suspension and termination

You may stop using the service and ask us to delete your account at any time. We may suspend or close accounts that breach these Terms or put the service or other users at risk. Except in serious cases, we will try to give you a chance to download your data before closing an account.

13. Changes to these Terms

We may update these Terms. If the changes are significant, we will notify you in the app and ask you to accept them again. If you do not agree with a new version, you can stop using the service and download your data.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without affecting any non-waivable rights you have under the consumer protection laws of your country of residence.
